Please be advised that, pursuant to
D.Lgs n. 196/2003
and Schedule B "Technical specifications regarding minimum security
measures", Portguardian proceed to the processing of data provided
to you in respect of the legislation on protection of the personal
data, such treatment will be based on the principles of fairness,
transparency and protection of your privacy and your rights.
Under Article 13 of
D.Lgs n. 196/2003,
we hereby provide the following information:
• The data will be used for institutional purposes, or related
instrument at the service that offers Portguardian on this site, and
more specifically to implement the service, or one or more
operations and contractually agreed to comply with legal
obligations;
• The processing of data will be made through instruments that
guarantee security and confidentiality and may also using automated
and computer to store, manage and transmit the data. Data will be
retained for the time prescribed by the rules of law;
• The provision of data is entirely optional. Any refusal to provide
such data does not involve any consequence;
• The data will not be disclosed to other persons or will be spread
unless expressly asking her consent;
• The owner the data-handling
is Portguardian. You may
exercise your rights at any time towards the person responsible for
data-handling, according to Article 7 of D.Lgs n.96/2003, which is
provided below in its entirety, for your convenience.
Art. 7 - Right of access to personal data and other rights:
1. The person concerned has the right to obtain confirmation of whether personal data concerning him or her exists or not, even though it may not have been recorded yet, and to have it communicated to him or her in an understandable form.
2. The person concerned is
entitled to obtain information about:
A.
the source
of personal data;
B.
the purpose and methods of treatment;
C.
the logic
applied in case of handling carried out with the aid of electronic
instruments;
D.
the identity of the responsible and representative in accordance
with article 5, paragraph 2;
E.
the people or categories of people to whom the data may be disclosed
or who may come into possession as a representative designated in
the State, managers or agents.
3. The person concerned is entitled to obtain:
A.
Updates, corrections or,
if it should be of his or her interest, additions to the data;
B.
The cancellation, transformation into anonymous form or blocking of
data handled in breach of the law, including data which does not
need to be kept for the purposes for which it was collected or
subsequently handled;
C.
A certificate stating that the operations under sub-paragraphs a)
and b) - including their content – have been communicated to those
to whom data and information were provided or disclosed, except the
case when this proves to be impossible or entails the use of such an
amount of means which is overtly non commensurate with the right
which is protected.
4. The person concerned is
entitled to object, entirely or in part:
A.
For legitimate reasons, to the handling of personal data regarding
him or her, even though it may be pertinent to the aim of the data
collection;
B.
Treatment of personal data regarding him or her for the purposes of
sending advertising or direct sales material, or for the purposes of
market research or commercial communications.
